These Terms and Conditions, referred to as the "Agreement," establish a legally binding contract between you, an individual customer, user, or beneficiary of this service ("Registered User"/"You"), and GSTShine Your utilization of the Service is contingent upon your compliance with the terms and conditions outlined below, which also include relevant policies. Please note that GSTShine Ltd retains the right, at its sole discretion, to amend, append, or remove sections of these terms and conditions at any time without prior notification. It is your responsibility to periodically revisit the "Terms & Conditions" link to stay informed about any alterations that the "Site/Application" may introduce.

Definitions

  • GSTShine means GSTShine and the same shall be referred to as 'the site' or 'the App'.
  • User refers to the customer, non-customer, agent, agency, merchant or website visitor.
  • Personal information refers to the information obtained by the GSTShine through its different channels like Website, Application.

  • Third-party product refers to the product that is offered by the GSTShine in collaboration with external organizations.
  • Charges or ‘service charges’ refers to the charges which the GSTShine levy upon the customers for a specific service or services. GSTShine reserves the right to change the service charges at any time.

Eligibility:

To qualify for the use of our services, you must meet the following criteria:
1. You must reside in India.
2. You must be at least 18 years old.
3. You must utilize our services for transactions in Indian Rupees exclusively, without involving any other currency.
4. You must access our services on a device capable of supporting them.
- We reserve the right to immediately terminate Your Account if we have reason to believe that Your Account is being used by any person who is not Eligible, or for any other reason.

PERSONAL INFORMATION

Personal Information means and includes all information that can be linked to a specific individual or to identify any individual, such as name, address, mailing address, telephone number, email ID and any details that may have been voluntarily provide by the user in connection with availing any of the services on GSTShine Site/App. We do not sell or share any personally identifiable information volunteered on this portal to any third party (public/private). Any information provided to this portal will be protected from loss, misuse, unauthorized access or disclosure, alteration, or destruction.
When you browse through GSTShine, we may collect information regarding the domain and host from which you access the internet, the Internet Protocol [IP] address of the computer or Internet service provider [ISP] you are using, and anonymous site statistical data.

Confidentiality of data:

  • We will not sell, share or rent your personal information to any 3rd party or use your email address/mobile number for unsolicited emails and/or SMS.
  • Any emails and/or SMS sent by GSTShine will only be in connection with the provision of agreed services & products and Our Privacy Policy.
  • We reserve the right to communicate your personal information to any third party that makes a legally-compliant request for its disclosure.
  • GSTShine shall abide by the statutory laws pertaining to Data Privacy as applicable in India and as amended from time to time.
  • OTHER TERMS AND CONDITIONS

    • This website is designed, developed and maintained by GSTShine.
    • The Registered User transacting on site/App, shall be responsible for maintaining the confidentiality of his/her User ID and Password and shall be responsible for all activities that occur under his/her User ID and Password.
    • The Registered User agrees that if he/she provides any information that is untrue, inaccurate, not current or incomplete or have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with this Terms of Use, GSTShine shall have the right to indefinitely suspend or terminate or block access of your account on the Site/App and refuse to provide with access to the Site/App.
      • Registration Fee as decided by GSTShine if any for use of this Site/App shall be paid by User.
    • The right to introduce new services and modify some or all of the existing services offered on the Site at GSTShine’s sole discretion without any prior notice.
    • The Registered User agrees that he will not host, upload, display, transmit, comment or share information which the user does not have right to and shall not use words which are harmful, inappropriate, obscene, offensive which advocates to rights of privacy against any individual or group or organization.
    • Though all efforts have been made to ensure the accuracy and currency of the content on this site/App, the same should not be construed as a statement of law or used for any legal purposes. In case of any ambiguity or doubts, users are advised to verify/check with the GSTShine customer care and/or other source(s), and to obtain appropriate professional advice.
    • Under no circumstances GSTShine will be liable for any expense, loss or damage including, without limitation, indirect or consequential loss or damage, or any expense, loss or damage whatsoever arising from use, or loss of use, of data, arising out of or in connection with the use of this site/App.
    • These terms and conditions shall be governed by and construed in accordance with the Indian Laws. Any dispute arising under these terms and conditions shall be subject to the jurisdiction of the courts of GNCT Delhi.
    • The information posted on this website could include hypertext links or pointers to information created and maintained by non-Government/private organisations. GSTShine is providing these links and pointers solely for your information and convenience. When you select a link to an external website, you are leaving the GSTShine site/App and are subject to the privacy and security policies of the owners/ sponsors of the external website.
    • GSTShine does not authorize use of copyrighted materials contained in linked website. Users are advised to request such authorisation from owners of linked websites.
    • In the event that the Customer has not done any transaction in last 6 months, at that point, his User Id is obligated for suspension.
    • In case a customer is found involved in any deceitful activities or malpractice, his user id would be obligated for suspension, and he/she would not be able to transact on GSTShine Site/App any further.
      • PKsotech is not a warrantor, insurer, or guarantor of the services to be provided by the third-party service providers.
    • I agree that GSTShine will not be liable in case of my encounter with any virus or malware attack on their website/App.

    BILL PAYMENTS

    GSTShine reserves the right to charge and recover from the Registered User, fees for availing the Services. These changes shall be effective from the time they are posted on to the GSTShine Website or App through which you are availing the Service. You are bound by such revisions and should therefore visit the GSTShine Website or Application through which you are availing the Service to review the current fees from time to time. In the event that you stop or seek a reversal of the Payment Instructions as may have been submitted, GSTShine shall be entitled to charge and recover from you and you shall be liable to pay such charges to the Service as may be decided by GSTShine. These charges shall be charged on to your designated e-wallet.

    GSTShine offers a convenient and secure way to make payments towards identified Biller(s) using a valid e-wallet. Depending upon the GSTShine business partner through whom the Service is availed by you
    (i) the specific features of the Service may differ
    (ii) the number of Billers available over the Service can differ
    (iii) the type and range of e-wallet that can be used to issue a Payment Instructions can differ and
    (iv) the modes/devices over which the Service can be accessed can differ; and
    (v) the charges, fees for availing the Service or any aspect of the Service can differ. Specific details related to these aspects would be available with the GSTShine business partner or the channel over which the Service is being availed. you agree to:

    • Provide true, accurate, current and complete information about yourself (“Registration Data”), your e-wallet details (“Wallet Data”), Your Biller details (“Biller Data”) and
    • Maintain and promptly update the Registration Data, e-wallet Data and Biller Data to keep it true, accurate, current and complete. If You provide any information that is untrue, inaccurate, not current or incomplete, or GSTShine has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, GSTShine has the right to suspend or terminate Your account and refuse any and all current or future use of the Service (or any portion thereof).
    In case the bill payment is not affected for any reason, you will be intimated about the failed payment by an e-mail or/And SMS.

    General Conditions of E-Wallet:

    You will be issued, basic account immediately after successful registration. You may recharge your e-Wallet through any of the Payment Gateways, Bill desk, Citrus or Payu. GSTShine Wallet is available only to resident Indians who have attained the age of 18 years and are competent to contract.

    GSTShine reserves the right to suspend/discontinue e-Wallet Services to You at any time, for any cause, including, but not limited, to the following-

    • For any suspected violation of the rules, regulations, orders, directions, notifications issued by RBI from time to time or for any violation of the terms and conditions mentioned in this document.
    • For any suspected discrepancy in the particular(s), documentation or Registration form provided by You;
    • To combat potential fraud, sabotage, willful destruction, threat to national security or for any other force majeure reasons etc;
    • If the same is due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons.
    • The Customer obligatorily needs to keep a base wallet amount in wallet at any random point of tim as decided by GSTShine.

    You are permitted to maintain and operate only one PKsotech e-Wallet. Any suspected non-conformity with this requirement shall be just cause for the suspension/ discontinuation of any/all Wallets associated with you by GSTShine.

    GENERAL TERMS PERTAINING TO THE USE OF UPI

    GSTShine acts as a Third-Party Application Provider (TPAP) under UPI.

    GSTShine is a TPAP authorized by NPCI to facilitate payments through PSP Bank(s). For this purpose, ICICI Bank and IndusInd Bank shall act as the PSP. GSTShine is a service provider participates in UPI through the PSP Bank.

    Through the agreement entered into between GSTShine, ICICI/IndusInd and NPCI, GSTShine shall facilitates grievances, complaints and provide resolution to the customers using our UPI application.

    GSTShine shall act as the first point of contact for all UPI related grievances/ complaints for its UPI customers. In the event the complaint or grievance remains unresolved, the User may escalate the issue to ICICI Bank/IndusInd Bank, followed by the User’s bank (linked to the UPI account) and NPCI thereafter, in the same order. If the User is still dissatisfied, the User may approach the Banking Ombudsman and / or the Ombudsman for Digital Complaints, as the case may be.

    What is NPCI?
    National Payments Corporation of India (NPCI) is an authorized payment system operated by RBI. NPCI owns and operates the UPI payment system.
    What is PSP bank?
    Payment Service Provider (PSP) is the banking company authorized to act as a service provider under the UPI framework. PSP engages the Third-Party Application Provider (TPAP) to provide UPI services to the end-user customers.
    What is TPAPs?
    Third Party Application Provider (TPAP) is an entity that provides the UPI compliant app(s) to the end-user customers to facilitate UPI based payment transactions.
    What is Customer’s Bank?
    The Bank where the end-user customer maintains his/her account that has been linked for the purpose of debiting/crediting the payment transactions made through UPI.
    Who is End User Customer?
    The end-user customer is the individual who uses UPI payment facility to send and receive payments.

    Roles & Responsibilities of NPCI

    • NPCI owns and operates the Unified Payments Interface (UPI) platform
    • NPCI prescribes rules, regulations, guidelines, and the respective roles, responsibilities and liabilities of the participants, with respect to UPI. This also includes transaction processing and settlement, dispute management and clearing cut-offs for settlement
    • NPCI approves the participation of Issuer Banks, PSP Banks, Third Party Application Providers (TPAP) and Prepaid Payment Instrument issuers (PPIs) in UPI
    • NPCI provides a safe, secure and efficient UPI system and network
    • NPCI provides online transaction routing, processing and settlement services to members participating in UPI
    • NPCI can, either directly or through a third party, conduct audit on UPI participants and call for data, information and records, in relation to their participation in UPI
    • NPCI provides the banks participating in UPI access to system where they can download reports, raise chargebacks, update the status of UPI transactions etc.

    Roles & responsibilities of PSP Bank

    • PSP Bank is a member of UPI and connects to the UPI platform for availing UPI payment facility and providing the same to the TPAP which in turn enables the end-user customers / merchants to make and accept UPI payments
    • PSP Bank, either through its own app or TPAP’s app, on-boards and registers the end-user customers on UPI and links their bank accounts to their respective UPI ID.
    • PSP Bank is responsible for authentication of the end-user customer at the time of registration of such customer, either through its own app or TPAP’s app
    • PSP Bank engages and on-boards the TPAPs to make the TPAP’s UPI app available to the end-user customers
    • PSP Bank has to ensure that TPAP and its systems are adequately secure to function on UPI platform
    • PSP Bank is responsible to ensure that UPI app and systems of TPAP are audited to safeguard security and integrity of the data and information of the end-user customer including UPI transaction data as well as UPI app security
    • PSP Bank has to store all the payments data including UPI Transaction Data collected for the purpose of facilitating UPI transactions, only in India
    • PSP Bank is responsible to give all UPI customers an option to choose any bank account from the list of Banks available on UPI platform for linking with the customer’s UPI ID.
    • PSP Bank is responsible to put in place a grievance redressal mechanism for resolving complaints and disputes raised by the end-user customer

    Roles & responsibilities of TPAP

    • TPAP is a service provider and participates in UPI through PSP Bank
    • TPAP is responsible to comply with all the requirements prescribed by PSP Bank and NPCI in relation to TPAP’s participation in UPI
    • TPAP is responsible to ensure that its systems are adequately secure to function on the UPI platform
    • TPAP is responsible to comply with all applicable laws, rules, regulations and guidelines etc. prescribed by any statutory or regulatory authority in relation to UPI and TPAP’s participation on the UPI platform including all circulars and guidelines issued by NPCI in this regard
    • TPAP has to store all the payments data including UPI Transaction Data collected by TPAP for the purpose of facilitating UPI transactions, only in India
    • TPAP is responsible to facilitate RBI, NPCI and other agencies nominated by RBI/ NPCI, to access the data, information, systems of TPAP related to UPI and carry out audits of TPAP, as and when required by RBI and NPCI
    • TPAP shall facilitate the end-user customer with an option to raise grievance through the TPAP’s grievance redressal facility made available through TPAP’s UPI app or website and such other channels as may be deemed appropriate by the TPAP like email, messaging platform, IVR etc.

    Dispute Redressal Mechanism

    • Every end-user customer can raise a complaint with respect to a UPI transaction, on the PSP app / TPAP app/NPCI using the following links:

    • End-user customer can select the relevant UPI transaction and raise a complaint in relation thereto
    • A complaint shall be first raised with the relevant TPAP in respect to all UPI related grievances / complaints of the end-user customers on-boarded by the PSP Bank / TPAP (if the UPI transaction is made through TPAP app). In case the complaint / grievance remains unresolved, the next level for escalation will be the PSP Bank, followed by the bank (where the end-user customer maintains its account) and NPCI, in the same order. After exercising these options, the end-user customer can approach the Banking Ombudsman and / or the Ombudsman for Digital Complaints, as the case may be.
    • The complaint can be raised for both the types of transactions i.e. fund transfer and merchant transactions
    • The end-user customer shall be kept communicated by the PSP / TPAP by means of updating the status of such end-user customer’s complaint on the relevant app itself.

    Refund Policy:

    • You are also responsible for the information relating to all transaction done on PKsotech Site/App.
    • While Wallet top-up through payment gateway, if money has been deducted from your card or bank account and service is not delivered within 24 hours of the completion of the transaction, then You shall inform us by sending an e mail to our customer services e mail address.
    • While performing service transactions, if amount has been deducted from your wallet and service is not delivered within 24 hours of the completion of the transaction, then You shall inform us by sending an e mail to our customer.
    • Please include in the e-mail the following transaction details like Amount, TXN ID, User ID, Wallet TXN ID and TXN Date for top-up cases and for other cases include Amount, TXN ID, User ID and TXN Date.
    • We will investigate the incident and, if it is found that amount was indeed charged to your card or bank account or wallet without delivery of the service, then You will be refunded the money within 21 working days from the date of receipt of your e-mail/Call.
    • All refunds will be credited to bank accounts for top-up cases and in wallet for other cases.
    • It will take 3-21 working days for the money to show in Your bank account depending on Your bank’s policy.
    • In case of charge back, if amount has been reverted back to your source account while service was delivered to the user, then GSTShine has full rights to recover that amount from user account.

    Fraud and Disputes

    Dishonestly obtaining a benefit, or causing a loss, by deception or other means shall amount to Fraud and it includes alleged, attempted, suspected or detected fraud. Any kind of fraud and dispute should be reported to GSTShine as soon it is detected.

    In case any customer is found involved in any deceitful activities or malpractice, his User ID would be obligated for suspension, and he/she would not be able to transact any further.

    Any and all differences and disputes whatsoever arising between GSTShine and Customer shall in the first instance be resolved mutually and in the event of a non-resolution the matter may be referred to a sole arbitrator to be appointed by GSTShine whose decision shall be final and binding on the parties. The proceedings of the Arbitration shall be held at Delhi. For any action and proceeding parties should irrevocably submit to the exclusive jurisdiction of the Courts at Delhi. The provisions of this clause shall survive the termination of the Agreement.
